TEXTS:
1. Clarkson, Kenneth W., Miller, Roger LeRoy, Jentz, Gaylord, A., Cross, Frank B., West's Business Law: Text, Cases, Legal, Ethical, Regulatory, and International Environment. Sixth Edition. West Pub. Co.: Minneapolis, Minn., 1995. BROWN COPY not blue.
EXAMS:
There are five exams. Each exam may be a combination of true-false, multiple choice, and/or short answer essay. Each of the first four exams will have at least twenty questions. The final exam is comprehensive and will have up to one hundred questions. Exam questions will come from the text and from the lectures. If the text and the lectures are in conflict, then the lectures will control.
For exam security reasons there will be at least two security
procedures in place.
First, no headgear (e.g., baseball caps, glasses, etc.) may be worn
during exam which obstruct the instructor's view of the student's eye pupils.
Second, no student may leave the 10AM exam room prior to the end
of the class meeting at 10:50AM.
Exam I, which will cover the review of Business Law I and the review of microeconomics, will be on Wednesday, January 28. Exam II, which will cover Units Four and Five, will be on Monday, February 23. Exam III, which will test over Units Six and Eight, will be on Friday, March 20. Exam IV, which will test over Units Seven, Nine, and Eleven, will be on Friday, April 24. The final exam, which is comprehensive, is at the Regent's scheduled final exam time (i.e., on May 6 from 10:00 AM to noon and on May 8 from 11:00AM to 1:00 PM, depending upon your enrollment). With the prior written approval of the instructor you may elect to take the exam at either time. There will be different final exams on Wednesday and on Friday. For Exams I, II, III, and IV, between 10:50 AM and 11:00 AM on exam day, it is not Academic Dishonesty for a student in the 10 AM section to talk about the exam with students in the 11 AM section; however, it is not wise, since any curve will be applied to the combined scores of the two sections.
LEGAL ANALYSIS OF "My Other Heart"
Each student shall prepare a typed legal analysis of a live play staged
by the UNO Drama Department entitled "My Other Heart." The typed
analysis shall be typed on two pages but shall be submitted on one sheet
of paper. The play will be staged in the Weber Fine Arts Building on
February 26 through 28 as well as March 4 through March 7.
This assignment has two drafts worth a total of 5% of the course. The first draft is worth 1% and will be graded by the instructor as either 100% or as 0%, depending upon whether the first draft objectively appears, in the professional judgement of the instructor, to be a good faith effort at a final draft of a college writing assignment. Another student in the class will critique your first draft during class. The second draft is worth 4% of the course, and will be graded by the instructor in 5% increments (e.g., 70%, 75%, etc.).
The legal analysis will examine a two transaction in the play: one from the perspective of contract law, and one from the perspective of tort law. One of the student-selected transactions must require resort to equity in order to obtain a remedy.
There will be two typed pages, but the assignment shall be turned
in
on one sheet of paper. The analysis of contract law shall start at
the top of the front of the sheet and shall be limited to the front of the
sheet. The analysis of tort law shall start at the top of the back of the
sheet and shall be limited to the back of the sheet.
The first draft of the legal analysis is due on April 3. Your cancelled ticket stub shall be stapled to the front of your first draft: failure to do so will result in a loss of 25% of the grade you earn on first draft assignment. The second draft of the legal analysis is due on April 10.
TYPING REQUIREMENTS:
All typed assignments shall be in 12 point and pitch typeface (i.e., 12 characters per inch and 6 lines per inch), shall be double spaced, shall use one inch margins on all four sides, and shall be typed on 8 1/2" x 11" white paper. All typed assignments shall use a header on each page, identifying (1) the author; (2) the assignment [e.g., First Draft, Contracts]; and (3) the class [e.g., LAWS 3920, 10 am MWF, Spring 1998].
The ENRON Computer Lab in CBA 403 has word processing software and hardware for you to use and for which you have been charged a fee. Campus computing rooms in CBA 007, EAB 009, and DSC 104 also provide computer support. Grammar, punctuation, and spelling do influence your grade. For page limits and other assignment specific TYPING REQUIREMENTS, see the specific assignment. Each significant failure to comply with typing requirements will cause, at a minimum, an automatic deduction of 5% of the assignment grade.
CLASS PARTICIPATION:
The skill of listening is the most important skill students develop during class participation. Listening is critical to effective management. During class participation, most of your time will be spent listening to other students solve problems. YOU will waste a huge amount of YOUR class time if YOU do not specifically work on developing YOUR listening skills.
Each day the instructor will randomly select students for that day's CLASS PARTICIPATION. The instructor's in class questions will focus on that day's readings in the text and previous text and lecture material. Note that the class meeting before exams is devoted entirely to Class Participation. You should study for this class meeting as if you were studying for the exam itself.
MAKE-UP WORK: Recall the instructor's office phone (402) 554-2823 has voice mail and the instructor's email address is mohara@unomaha.edu.
Make-up work is strongly discouraged. There are two prerequisites for make-up work.
1. 24 hour prior notice of your intended absence, unless for sufficient reason (e.g., death of an immediate family member);
AND
2. written verification by an impartial third party (e.g., letter from mortician on letterhead).
ACADEMIC DISHONESTY:
Any form of academic dishonesty (e.g., looking on another student's exam) will be grounds for a course grade of "F."
